The site https://www.mandofoods.com/ (hereinafter, the "Site") is an online sales site for Agro-food products, Made in Côte d'Ivoire. These general conditions of sale are concluded between on the one hand, MANDO FOODS & CO, and on the other hand, Internet users who wish to make a purchase on the website https://www.mandofoods.com/

1.   DESCRIPTION OF THE SERVICE

The Site is an electronic commerce site which offers its Customers high-end quality Products. Products are available while stocks last and the purchase deadline for ephemeral sales. The products are sold in Ivory Coast, in Europe, in the United States etc .....

The GTC apply to all transactions and all contracts concluded with Customers of the Site, as well as to relations between MANDO FOODS & CO and its Customers. No other general condition of sale or purchase is applicable, unless expressly agreed otherwise between the parties.

1.   PURCHASES OF PRODUCTS ON THE SITE

The Internet user visiting the MANDO FOODS & CO site will find on each product page, information sheets containing the main characteristics of the products, as well as mandatory information under applicable law. The Customer agrees to read them carefully before placing an order on the Site.

MANDO FOODS & CO reserves the right to modify the prices of the Products. The prices indicated at the time of the order are valid subject to possible obvious errors in the prices. In this case, MANDO FOODS & CO reserves the right to cancel the sale. The site reserves the right to modify the selection of products available on the Site, in particular according to the constraints linked to its suppliers.

The photographs are provided by the Supplier and are presented for information purposes only and have no contractual value. Unless expressly stated otherwise on the Site, all products sold by MANDO FOODS & CO are new and comply with current Ivorian legislation and applicable CODINORM standards.

The Customer or the visitor who wishes to purchase one or more products on the Site must comply with the following process:

·        The Customer or visitor selects the Product (s) they wish to purchase by clicking on the "Add to basket" icon.

·        The Customer or visitor selects the Product (s) they wish to purchase by clicking on the “Add to basket” icon. The Customer must first check the availability of the product and the geographical area of delivery. After having verified his selection, he must then validate the choice of the selected Product (s) by clicking on the “order” icon;

·        If he is already a Customer of the Site, the visitor must check the billing and delivery information that he entered during the first order;

·        If he is a new Customer of the Site, the visitor must complete the information form, that is to say all the mandatory fields indicated by an asterisk (*);

·        The shipping costs of the order are then indicated to the Customer. He must click on the “Continue” icon to continue his order;

·        The Customer must then read the GTC and accept them before proceeding to payment. By clicking on the first button "Continue" to place the order then on the second button "Order" to confirm the said order, the Member thereby acknowledges having read, understood and accepted the GTC without limitation or condition;

·        When the order is finalized, MANDO FOODS & CO confirms the order to the Customer by sending him a summary email

1.   PRICE

The prices are indicated in CFA francs all taxes included and do not include delivery costs.

Shipping costs are calculated separately and displayed when ordering.

When the order summary is displayed, the total price will be displayed with the delivery costs

1.   DELIVERY

Customers are responsible for receiving goods on working days (excluding Saturdays, Sundays and public holidays. The delivery address may be different from the Customer's home address.

In any case, it is the Customer's responsibility to ensure the conditions of accessibility of the place, floor or delivery room and to inform MANDO FOODS & CO or the carrier when taking appointment. If delivery could not be made due to the Customer's failure to inform MANDO FOODS & CO and / or the carrier beforehand, MANDO FOODS & CO cannot be held liable and the costs associated with any new delivery will be borne by the Customer. ;

  Any new delivery resulting from an error concerning the information necessary for the delivery such as (the delivery address, the place of delivery, the accessibility of the place, the telephone number for making an appointment) and / or the absence of the Client at the fixed appointment, will be the responsibility of the Client. In addition, where applicable, MANDO FOODS & CO reserves the right to cancel the order.

Each delivery is deemed to have been made as soon as the Product (s) is made available to the Customer, in particular by the carrier, as evidenced by the control system used by the carrier.

  Without prejudice to the time available to the Customer under his right of withdrawal as provided for in Article VIII of the General Conditions, it is the Customer's responsibility to check the shipments on arrival and to make any reservations and complaints which appear justified, or even to refuse the package, if it is likely to have been opened or if it bears clear signs of deterioration.

Said reservations and complaints must be sent to MANDO FOODS & CO by means of the contact form within three (3) working days following the delivery of the Products.

  In this writing, the Customer must provide any justification as to the reality of the anomalies observed.

If the non-conformity is proven and MANDO FOODS & CO agrees to take back the Product, the same Product will be shipped by MANDO FOODS & CO subject to its availability. Failing this, the Customer may request the cancellation of his order and its reimbursement or to benefit from another Product of the same price.

  If the delivery is made by a carrier, the delivery schedule will be communicated at least 24 hours before said delivery.

  Delivery times depend on the supplier and will be indicated on each sales page of the Products offer. These deadlines are calculated in working days (excluding Saturdays, Sundays and public holidays) from the date of end of sale of the Products concerned, as announced on the site.

  It is possible that despite the precautions taken by MANDO FOODS & CO, that the delivery times of our suppliers are longer than those initially indicated, in particular in the case of a shortage of stock, a supply problem, or non-availability. of the Product sold. In this case, MANDO FOODS & CO undertakes to inform the Customer as soon as possible by e-mail.

  MANDO FOODS & CO cannot be held responsible for any delay in delivery.

MANDO FOODS & CO reserves the right to cancel the order if delivery by carrier fails three (3) times due to the Customer's absence during delivery. MANDO FOODS & CO undertakes in this case to reimburse the price of the Products excluding delivery costs.  In the event of delivery with an appointment:

If delivery cannot take place due to the absence of the Customer or his representative, MANDO FOODS & CO will invoice the Customer for the additional costs incurred by a new presentation of the carrier.

·        PAYMENT

The Customer will make his payment by credit card, or by Mobile Money. Transactions are debited immediately t after Customer payment

1.   RETURNS

PRODUCTS DAMAGED DURING TRANSPORT

Given the fragility of the items shipped, we attach great importance to the packaging and take all necessary precautions to protect the items against possible shocks. If, however, your items reach you damaged, we invite you to notify us within 3 days of delivery, by sending a photograph attesting to the damage to mandofoods@gmail.com, and specifying the order number concerned.

We will contact you to offer you the exchange of the item to be replaced subject to its availability, a credit note or a refund of the item.

  In the case of delivery by carrier of large packages, MANDO FOODS & CO cannot be held liable if the Customer has not noted the reservations during the delivery of his package, or even if he has not. not refused for non-compliance.

    VIII. WITHDRAWAL PERIOD

In accordance with the Consumer Code, you have the right to retract and return the products ordered for 03 clear days from the date of delivery thereof.

The return of all the products ordered gives rise to a refund equal to the total amount paid, i.e. the purchase price of the product (s) purchased, shipping costs paid to the order included. The refund is made by any means of payment within 30 days of receipt by MANDO FOODS & CO of the request to exercise your right of withdrawal, provided that the product has been returned to us.

  In the event of exercise of the right of withdrawal, the Customer must return the Products, specifying the order number and the reason for the return to the address which will be communicated to him by the MANDO FOODS & CO customer service.

1.   EXCLUSION

  MANDO FOODS & CO reserves the right, without prior notice, to refuse certain promotional benefits, to temporarily block or exclude from the Site, and to block any new use of the Site, without prejudice to any other recourse or legal action a Member who :

·        Transmit any message containing computer viruses;

·        Impersonate or impersonate another person or entity;

·        Transmit any content contrary to the laws, public order and good morals.

XVII. APPLICABLE LAW AND COMPETENT JURISDICTION

These T & Cs as well as the relationship between the Member and MANDO FOODS & CO  are governed by Ivorian law, in particular law n ° 2016-412 of June 15, 2016 relating to consumption and the code of goods and obligations.
